Investigations for the Protection of Minor Children: the concept of Parental Responsibility
Family law was renewed by Legislative Decree no. 1542013. Among the most important innovations is the introduction of the concept of "parental responsibility" which redefines the concept of parental authority. Generally the concept of parental authority represented the complex of powers exercised over children until they reach the age of majority, the introduction of Legislative Decree no. 1542013 modified articles 315 and following of the Civil Code.

"The child has the right to be supported, educated, instructed and morally assisted by his parents, respecting his abilities,

The child has the right to grow up in the family and to maintain meaningful relationships with relatives.
The minor child who has reached the age of twelve, and even of a younger age where capable of discernment, has the right to be
listened to in all matters and procedures that concern him.
The child must respect his parents and must contribute, in relation to his abilities, his assets and his income, to the maintenance of the family as long as he lives with it".
Parents or guardians have the obligation to educate and supervise their minor children, parental responsibility establishes that they must educate, protect and look after the interests of minors. This occurs in relation to the fact that the holder of parental responsibility acts as the legal representative of the minor, as the minor lacks the capacity to act until he reaches adulthood. What is meant by ability to act? The same is the ability of the subject to carry out legal acts aimed at acquiring or exercising their rights and assuming obligations. This is established by article 2 of the Civil Code.
